The two flags diverge most on VAT. Malta, as an EU member state, sits inside the EU's VAT and customs area, so a Malta-flagged yacht's VAT position is generally an EU VAT question from the outset. Cayman sits outside any VAT territory, so a Cayman-flagged yacht starts from a different position. Does flagging in the Cayman Islands avoid EU VAT?Link to this section
No. Where the vessel is used and who owns it both bear on the exposure whichever flag it flies, so the flag alone settles nothing. What a non-EU flag can do is open temporary admission to an owner established outside the customs territory, which is a relief with conditions rather than an exemption.
