Terms of Use

1. Who we are

WhichFlagToFly is operated by WhichFlag LLC, a limited liability company formed in Wyoming, at 32 N Gould St, Ste R, Sheridan, WY 82801, United States. In these Terms, "we", "us" and "our" mean that company, and "you" means the person using the site. You can reach us at info@whichflagtofly.com.

These Terms of Use are an agreement between you and us. By using the site you accept them. If you do not accept them, do not use the site.

2. What this site is

WhichFlagToFly does two things:

• It publishes information about registering yachts and private aircraft: fact tables with their sources and dates, guides, comparisons and calculators.
• It introduces you to firms. If you want professional help, you can send us an inquiry through the site. A person here reads it and passes it by email to one or more firms that can help with the countries and services you asked about.

We are not a law firm, tax advisor, registry, broker, corporate service provider or insurer, and we do not provide those services. Using the site or sending an inquiry does not create an attorney-client, advisor-client or fiduciary relationship with us.

WhichFlagToFly does not charge customers. Firms and partners pay WhichFlagToFly, not the other way round. You are never asked for card or bank details on this site.

3. Information only, not advice

Everything on the site, including calculator and comparison results, is general information. It is not legal, tax, financial, insurance or regulatory advice and does not replace advice from a qualified professional about your circumstances.

4. Accuracy and sources

Fees, taxes, rules and timelines on the site come from registries, tax authorities and other public sources, as of the date shown next to each fact. Those sources change, sometimes without notice, and may apply differently to your case. Calculator and comparison results are estimates.

We do not promise that any fact, result or guide is complete, accurate or current. Check any figure with the relevant authority or a professional before you rely on it. If you think something is wrong or out of date, tell us at info@whichflagtofly.com.

5. Inquiries and introductions

• What we share, and when. When you send an inquiry, we first pass your answers about the asset, the countries and the services you need, without your name or contact details, to one or more firms that can help with what you asked about. Once a firm agrees to speak to you, we share your name and contact details with that firm and introduce you to each other by email. We do not pass your details to anyone for their own marketing. How we handle your information is set out in the Privacy Policy.
• Stopping or changing it. Email info@whichflagtofly.com to stop us passing on your inquiry, or to ask for a different firm.
• Referral fees. Firms we introduce you to may pay us a referral fee. You are never charged. Whether a firm pays us, or how much, does not decide which firm receives your inquiry.
• Your dealings with a firm are yours. Any engagement is between you and the firm. Its scope, fees, advice, conduct and results are the firm's responsibility, not ours. We do not endorse, supervise or guarantee any firm.
• No guarantee. Sending an inquiry does not guarantee that a firm will contact you, take on your matter or offer particular terms.

6. Acceptable use

You may read, print and share pages of the site for your own purposes. You may not:

• scrape, crawl or copy the site or any substantial part of it by automated means, or republish or resell its content, except through the Public Data API under section 7;
• use the content to build a competing product or dataset, or to train a machine learning model, except as section 7 allows;
• interfere with the site, test it for vulnerabilities, get around any access control, or send more traffic than normal reading would;
• send an inquiry that is not genuine, or impersonate anyone;
• use the site for anything unlawful.

7. Public Data API

We offer a free, read-only data API, documented at /developers. You may use it, and quote and display the data it returns, on these conditions:

• Attribution is required. Wherever you display, quote or summarize the data, show the attribution text given on the developers page and in each API response, with a link back to the site.
• Stay within the rate limits stated on the developers page.
• The data is information only, as described in sections 3 and 4, and is provided without warranty under section 10.

We have not adopted a separate open data license. We may change, limit or withdraw the API at any time.

8. Intellectual property

The site's text, design, compilations and code belong to us or our licensors. Individual facts belong to no one; our selection, arrangement, wording and presentation of them are ours. Apart from what sections 6 and 7 allow, you need our written permission to reuse them.

9. Other sites

The site links to registries, authorities, publications and firms. We do not control those sites and are not responsible for their content or privacy practices.

10. No warranties

The site and the API are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the site will be available, error free or secure.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, savings, data or opportunities, arising from the site, the API, an inquiry, an introduction, or anything a firm does or does not do.

Our total liability for all claims relating to the site is limited to US$100. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, or removes consumer rights you have under the law where you live.

12. Indemnity

You agree to cover our losses and reasonable legal costs from claims caused by your breach of these Terms or your misuse of the site or the API, where the law where you live allows this.

13. Governing law and venue

These Terms and any dispute about them or the site are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. The state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction, and you and we consent to that jurisdiction and venue.

If you are a consumer in the EEA, the United Kingdom or Switzerland, you keep the protection of the mandatory consumer laws of your country and may bring proceedings in its courts.

14. Disputes

Email info@whichflagtofly.com first. We will try to resolve the issue with you for 30 days before either of us goes to court. There is no mandatory arbitration. To the fullest extent the law allows, you and we each waive any right to a jury trial. Any claim must be brought within one year after it arises, unless the law where you live gives you longer.

15. Changes

We may update these Terms. The effective date at the end shows when the current version took effect. For a material change, we will post a notice on the site before it takes effect. If you keep using the site after that, the new Terms apply.
