EU flag or non-EU flag for a yacht

Whether to flag a yacht inside the EU customs territory or outside it, and what each side changes for import VAT, evidence and visiting reliefs.

A yacht's flag and its customs status are two different things that owners routinely treat as one. Registering inside the European Union puts the vessel on one side of a customs frontier; registering outside it puts the vessel on the other. Neither settles what tax is owed, and both change how the question is asked.

What does an EU flag actually change?Link to this section

It changes the starting position, not the answer. A vessel flagged inside the Union is already inside the customs territory for the purposes of the flag, so the question becomes whether it is in free circulation and what evidence proves it. The rate that applies is the member state's own.

What does a flag outside the EU open up?Link to this section

One thing above all: temporary admission, which lets a vessel used by a person established outside the customs territory visit for a limited period without the import charge falling due. It is conditioned on the user rather than on the flag, so a non-EU flag is necessary and not sufficient.

Does an EU flag make chartering in Europe easier?Link to this section

It removes some questions and creates none of the permissions. Authorization to carry paying guests is granted by the coastal state for its own waters, whatever flag the yacht flies, and commercial registration with the flag is a separate act from that authorization.

Which side of the line suits a specific yacht?Link to this section

It follows the owner's residence and the yacht's itinerary rather than a general preference. An owner established inside the Union whose yacht will live in the Mediterranean is in a different position from a non-resident owner cruising there for part of the year, and the two rarely choose alike.
