ISM, ISPS and MLC for yachts: what your flag requires

Whether a commercial yacht needs full ISM, an ISPS certificate or something lighter depends on its size and its flag. Compared flag by flag, with sources.

A compliance package covers the three code families a commercial yacht is surveyed against: the ISM Code for safety management, the ISPS Code for security and the Maritime Labour Convention for labor standards. All three trace back to international conventions, but the size at which a smaller yacht has to comply with the full version of each differs by flag. What is the ISM Code, and does it apply below the large-ship threshold?Link to this section

The International Safety Management Code requires a documented safety management system, a shore-based company to hold responsibility for it, and independent auditing. Above the size threshold every flag in this comparison applies it in full; below that threshold, the flags diverge sharply on what, if anything, is mandatory.

What is ISPS, and when does a yacht need an ISSC?Link to this section

The International Ship and Port Facility Security Code sits alongside ISM and requires its own security assessment, a designated security officer, and an International Ship Security Certificate above the same large-ship threshold ISM uses. Below it, whether ISPS applies depends again on which flag the yacht flies.

Which code will your yacht be surveyed against?Link to this section

A commercial yacht is surveyed against one named code, and that code, not the yacht's size alone, sets its specific thresholds, exemptions and paperwork. Malta, the Red Ensign registers and the Marshall Islands each publish their own code, with their own tests for what counts as a commercial yacht.

What does an MLC inspection check?Link to this section

The Maritime Labour Convention sets minimum standards for crew working and living conditions and, where it applies, requires a signed seafarers' employment agreement, inspection-ready records, and evidence of financial security in case wages go unpaid or a crew member is abandoned. An MLC inspection checks the paperwork as much as the vessel.

Some flags fold MLC compliance directly into their own survey process rather than treating it as separate. Ask a compliance or management firm which parts of MLC apply to a specific yacht and flag rather than assuming the Convention baseline is all that applies.

What does a compliance package cost?Link to this section

The cost of a compliance package is the survey and certification fees the flag charges, plus the shore-based company's own fee for holding and auditing the system. Only the first is published. No neutral source sets out what a compliance provider charges for the second, so this page states no fee band and points instead at what each flag requires.

Who runs compliance for you day to day?Link to this section

An owner can hold the safety management responsibility personally or appoint a shore-based company to hold it instead; most commercially operated yachts appoint a manager who already runs ISM, ISPS and MLC compliance for other vessels and has the audit relationships in place.
