Madeira yacht registration process step-by-step
The end-to-end path to registering a yacht on the Madeira International Shipping Register, from eligibility through to renewal.
Registering on the Madeira International Shipping Register (MAR) follows a fixed sequence: confirm eligibility, choose private or commercial status, prepare documents, register provisionally, complete survey and compliance work, sort crew certification, then move to full registration and keep meeting renewal obligations. All of it sits within Madeira's standing as an EU flag under Portuguese administration. The registry's own processing seldom holds an application up. Assembling documents after provisional registration usually does.
1. Confirm eligibilityLink to this section
Check first that the vessel and the intended owner structure both qualify. Madeira's vessel eligibility position: No maximum age: the technical commission decides case by case, and MAR accepts commercial yachts of 7 to 50 meters carrying up to 12 passengers plus crew, and pleasure yachts above 7 meters.Decreto-Lei n.º 17/2022, de 18 de janeiro (Diário da República, 1.ª série, n.º 12), tenth amendment to Decreto-Lei n.º 96/89, published by the Governo Regional da Madeirawww.madeira.gov.ptRetrieved 2026-08-12Open sourceInformational only, not legal, tax or financial advice. Its owner eligibility position: Both free-zone licensed entities and outside entities may register; licensed entities face no nationality or residence test on their management.Decree-Law nr. 96/89, of 28 March, consolidated English text as amended through Decree-Law no. 17/2022, published by SDM - Sociedade de Desenvolvimento da Madeira (concessionaire of the Madeira International Business Centre)www.ibc-madeira.com · art. 15(1)Retrieved 2026-08-12Corroborating source, not the register's own publicationOpen sourceInformational only, not legal, tax or financial advice. 2. Choose private or commercial statusLink to this section
Decide early whether the yacht will be registered for private pleasure use or commercial charter. This determines the survey standard and the crewing rules that apply from here on, and it shapes how charter activity within the EU is treated. Madeira's position on this split: One register serves both, with recreational craft carved out of crew quota, cabotage and mortgage-enforcement rules.Decree-Law nr. 96/89, of 28 March, consolidated English text as amended through Decree-Law no. 17/2022, published by SDM - Sociedade de Desenvolvimento da Madeira (concessionaire of the Madeira International Business Centre)www.ibc-madeira.com · art. 15(5)Retrieved 2026-08-12Corroborating source, not the register's own publicationOpen sourceInformational only, not legal, tax or financial advice. 3. Gather documentsLink to this section
Assemble title evidence, builder's certificate or bill of sale, any deregistration confirmation from a prior flag, and evidence of the vessel's EU VAT-paid status where relevant. Where the vessel will be financed, the lender's own documentation requirements typically need to be satisfied ahead of mortgage registration. Madeira's required document set: The application needs proof of ownership, the previous deletion certificate, a survey report, two photographs and any mortgagee's consent.Decreto-Lei n.º 192/2003, de 22 de agosto, and the annexed regulation applicable to recreational craft registered or to be registered in the Madeira International Shipping Register, Diário da República, I Série-A, n.º 193, 22 August 2003, pp. 5420 to 5424files.diariodarepublica.pt · Anexo, art. 5.º(1)Retrieved 2026-08-29Open sourceInformational only, not legal, tax or financial advice. 4. Provisional registrationLink to this section
MAR offers provisional registration, a faster initial entry letting the vessel fly the flag and begin operating while fuller survey and compliance evidence is assembled for full registration. Madeira's provisional registration position: Provisional registration is an exception for a yacht: it runs 90 days on a core set of four documents, extendable once by up to 30 days on request or 60 days by the technical commission.Decreto-Lei n.º 192/2003, de 22 de agosto, and the annexed regulation applicable to recreational craft registered or to be registered in the Madeira International Shipping Register, Diário da República, I Série-A, n.º 193, 22 August 2003, pp. 5420 to 5424files.diariodarepublica.pt · Anexo, art. 4.º(2)Retrieved 2026-09-01Open sourceInformational only, not legal, tax or financial advice. 5. Survey and code complianceLink to this section
The vessel is surveyed against the applicable safety and construction standard for its size and use. Commercially operated yachts commonly need to meet a large-yacht code, often cross-referenced to established international standards such as the UK's MCA codes, for vessels of this type. Madeira's survey requirements: Every yacht needs a registration survey report to register; private yachts are then surveyed at five years and every three years after, commercial yachts annually with a dry-dock hull survey every two years.Decreto-Lei n.º 192/2003, de 22 de agosto, and the annexed regulation applicable to recreational craft registered or to be registered in the Madeira International Shipping Register, Diário da República, I Série-A, n.º 193, 22 August 2003, pp. 5420 to 5424files.diariodarepublica.pt · Anexo, art. 5.º(1)(g) and art. 10.º(1)Retrieved 2026-09-01Open sourceInformational only, not legal, tax or financial advice. 6. Crew certification and MLCLink to this section
Crew need certification matched to the vessel's size and operating category, and commercially operated vessels typically fall under the Maritime Labour Convention (MLC), which sets minimum standards for seafarers' working and living conditions internationally. Madeira's crew certification requirements: A 30 percent Portuguese, European or Portuguese-speaking crew quota applies, but never to recreational craft.Decree-Law nr. 96/89, of 28 March, consolidated English text as amended through Decree-Law no. 17/2022, published by SDM - Sociedade de Desenvolvimento da Madeira (concessionaire of the Madeira International Business Centre)www.ibc-madeira.com · art. 20(1) and (3)Retrieved 2026-08-12Corroborating source, not the register's own publicationOpen sourceInformational only, not legal, tax or financial advice. Contact a qualified professional for current information. Its MLC applicability position: The Maritime Labour Convention binds Portuguese-flag ships, Portugal having ratified it in January 2015; crew terms follow the international conventions in force in Portugal, with mandatory sickness, occupational disease and maternity cover.Decree-Law nr. 96/89, of 28 March, consolidated English text as amended through Decree-Law no. 17/2022, published by SDM - Sociedade de Desenvolvimento da Madeira (concessionaire of the Madeira International Business Centre)www.ibc-madeira.com · art. 22Retrieved 2026-09-01Corroborating source, not the register's own publicationOpen sourceInformational only, not legal, tax or financial advice. 7. Charter permissions within the EULink to this section
An EU flag removes some of the questions a non-EU-flagged yacht faces when chartering within the EU, though the applicable charter authorization still needs to be confirmed and in place before trading. Madeira's charter permissions position within the EU: An EU flag opens Member State cabotage for commercial trips, but confers nothing in United States waters.Council Regulation (EEC) No 3577/92 of 7 December 1992 applying the principle of freedom to provide services to maritime transport within Member States (maritime cabotage), EUR-Lexeur-lex.europa.eu · art. 1(1)Retrieved 2026-08-18Open sourceInformational only, not legal, tax or financial advice. 8. Full registrationLink to this section
Once survey, compliance and any provisional-registration conditions are satisfied, the vessel moves from provisional to full registration. Madeira's stated timeline for reaching full registration: No published processing time; provisional entry available, then 90 days to complete the file.Decreto-Lei n.º 192/2003, de 22 de agosto, and the annexed regulation applicable to recreational craft registered or to be registered in the Madeira International Shipping Register, Diário da República, I Série-A, n.º 193, 22 August 2003, pp. 5420 to 5424files.diariodarepublica.pt · Anexo, art. 3.º(1)–(2)Retrieved 2026-08-29Open sourceInformational only, not legal, tax or financial advice. 9. Mortgage registration, if financedLink to this section
Where the yacht is financed, the lender's mortgage is registered as a distinct step, giving the lender's security public priority and legal enforceability. Madeira's mortgage registration position: Mortgages take written authenticated form, and the parties may choose and register the governing law.Decree-Law nr. 96/89, of 28 March, consolidated English text as amended through Decree-Law no. 17/2022, published by SDM - Sociedade de Desenvolvimento da Madeira (concessionaire of the Madeira International Business Centre)www.ibc-madeira.com · art. 14(4)Retrieved 2026-08-12Corroborating source, not the register's own publicationOpen sourceInformational only, not legal, tax or financial advice. 10. Renewal and standingLink to this section
Registration either runs on a renewal cycle or continues for as long as the annual fee is paid; each register publishes which. Standing also depends on the vessel's inspection record under port state control regimes such as the Paris MoU. Madeira's renewal cycle: There is no published fixed term or periodic re-registration; the recurring obligation is the annual maintenance fee, due every 12 months.Portaria n.º 145/2003, de 29 de outubro (amends articles 2.º, 4.º and 5.º of Portaria n.º 135/94, de 1 de agosto, the fee regime for recreational craft registered in MAR), Jornal Oficial da Região Autónoma da Madeira, I Série, n.º 122joram.madeira.gov.pt · Portaria n.º 145/2003, art. 1.º (Portaria n.º 135/94, art. 2.º(2)(a))Retrieved 2026-09-01Open sourceInformational only, not legal, tax or financial advice. Does an EU flag make chartering in the EU easier?Link to this section
It removes some of the questions a non-EU flag raises, but the authorization to carry paying guests still has to be in place, and each coastal state decides that for its own waters. Commercial registration and a charter permission are separate steps under most flags.

How long does full registration take?Link to this section
The register's published turnaround runs from the point its file is complete. Assembling the title chain, the tonnage certificate and any closure transcript from a previous flag is the part an owner controls, and on most applications it is the longer half of the calendar by some margin.

Can the yacht fly the flag before full registration is complete?Link to this section
Where the register offers a provisional entry, yes. It exists for a vessel that has to move or complete a sale before the full file is ready, it is time-limited, and it is not a cheaper substitute for full registration. The provisional window is usually the deadline that actually binds.

Does the Maritime Labour Convention apply to the crew?Link to this section
It turns on the vessel's size and on whether it is operated commercially rather than on the flag alone. Where it applies it is inspected rather than self-declared, and it sets seafarer employment agreements, hours of rest, repatriation and accommodation standards that a registration agent can check against a specific vessel.

What happens at renewal, and if the yacht later moves flag?Link to this section
Registration runs on a cycle and has to be renewed on its own schedule. Leaving is a separate act again: the vessel is closed off one register before it can join another, and a mortgagee can hold that up until its security is discharged.
